Kevin Durant - Rookie of the Year
Posted on Wednesday, April 30th, 2008 at 9:51 am by Big Chris
Was there any doubt? Multiple anonymous sources in the NBA have said that Durant will be your 2007-08 NBA rookie of the year!
Congratulations to Kevin Durant for his hard work this past season. He stayed classy in spite of the turmoil the organization is in. Durant stayed focused and improved throughout the season, especially in the last 2 months, when it was probably the most difficult to do so. Durant never threw in the towel, and he played his heart out regardless of who had been traded/added to the team through the year.
Among all rookies this past season, Durant led all with 20.3 points per game, 9th in field goal percentage, 10th in rebounding, and 3rd in assists. Kevin Durant is the first Rookie of the Year award winner for the Seattle Supersonics franchise.

Im so happy for KD!!!
April 30th, 2008 at 9:55 am
Congrats KD.
Now can he please say something publicly in support of the team?
It’s not like they’re going to fire him. He’s the best scorer on the team.
April 30th, 2008 at 9:58 am
The Times said that he is being awarded this in Seattle? is there a way we can get a contingent of SOS to attend? I would love to attend.
April 30th, 2008 at 10:04 am
Yes does anyone know when and where this award will presented?
Also,KD kind of already has given his support for staying here when in the last game he was clapping with the crowd to the SAVE OUR SONICS chant and in his post game interview he said he wanted to stay. While I would love for the players to be more outspoken about this issue that is not really for them to do and they understand its a business and we cant expect them to do too much….on the other hand wouldnt it be great if the whole team came out and said screw you clay if you move us to OK were not playing! (I know that wont happen but I can wish.)
April 30th, 2008 at 10:24 am
Great season KD. I have stated before that Durant is a one of a kind player and people thought I was crazy. Hes only 19. Just wait a couple years and he will lead us to a championship. Hes that good. Clutch as Ive ever seen at that age. Durant improved over the long season wich is a good sign that he is very coachable. People said his body couldn’t take an entire season, but yet he got better and played in 80 games. Just remember what we are fighting for. We are fighting for the right to keep Kevin Durant in green and gold. What a game to end the season. 42 points, 13 rebounds and 6 assists. That after he won the last game in Seattle by scoring the final 4 points with less than 30 seconds when the Supes were down by one. CLUTCH! Like JORDAN!

Off topic:
OK we are on for the public Save Our Sonics meeting.
Date/Time: Saturday May 3 from 10AM - 12PM.
Location:
Jewish Community Center (JCC)
3801 E Mercer Way
Mercer Island, WA 98040
(206) 232-7115
The JCC is a place where NBA players train in the offseason, and there are tons of non-religious activities that go on there, so we think it is quite appropriate for our event. It’s much like your local YMCA.
There’s parking and a huge room for us that was free for our use.
More later.
Cheers

Congrats, KD!
I sure hope all the silence from Slade, City, SOS, Schultz, etc. is planned and not because we have nothing left to fire.
Probably activity behind the scenes as usual.
April 30th, 2008 at 11:17 am
Congrats KD!
All quiet on the SOS front.
I guess I will use this chance to actually do some work.
NEVER RELENT!
NO RELO!
JUST CLAY GO!
April 30th, 2008 at 11:51 am
Wow Avery Johnson is out as Dallas coach according to reports.
Also I agree with Lapordo…hopefully the silence from Slade, Schultz, etc isnt due to lack of information or whatever. I have to have faith there just working behind the scenes!
April 30th, 2008 at 11:57 am
Avery will find a new gig.
He is pretty much the scape goat in Dallas.
April 30th, 2008 at 11:57 am
The coaching carnage continues. I’d be happy with Johnson or D’Antoni taking over the Sonics. PJ just didn’t impress me at all, or perhaps better said, he lived up to my expectations.
Does anyone have any odds or a Sonics coaching change? I’m thinking it’s not likely. But wouldn’t D’Antoni be a nice fit with our newly certified ROY and Luke?
Congrats to KD.
April 30th, 2008 at 11:58 am
I think all parties are working hard and are confident. I think their is just a time to be silent and work on the case. They have been working this for months and sometimes it is best to say nothing. NO NEWS IS GOOD NEWS!!
April 30th, 2008 at 12:01 pm
If the Sonics are forced to play in Seattle for two more years than PJ will be the coach. Bennett and Presti are fed up with him and the players don’t respond which makes him a perfect fit for 2 lame duck seasons. He will not coach the team if they move to OKC. Durant and Green think PJ is a joke and have often been know to make fun of the coach after he leaves the room after speaking to the team. It sad that they use PJ in this way.

- Say what you want about Avery Johnson and Mike D’Antoni…but the fact that they got fired after the types of seasons they have had lately is just more evidence of how poor the NBA business model has become.
One of the key comments that have been made about the Sonics situatoin is “in 04-05 when they were winning the team turned a profit”. That is completely understandable. If a team is winning it is much more likely to bring fans into their Arenas and more revenue into the owner’s pockets.
However, it is just a simple fact that 14 teams a year are not gonig to make the playoffs. No matter how well everyone plans there are going to be 14 teams that are considered “not winning”. How can the league continue to support itself when the only way to make money for most teams is to have a deep playoff run?
It is quite obvious that the league is easily on its way to a work stopage like the one the that happened in the NHL. One has to wonder if losing a year of playing will push the NBA closer to tier two status then MLB and the NFL.
April 30th, 2008 at 12:14 pm
sonicsman, my sentiments ezactley on the coach situation. if they are forced to stay I see a big dose of PJ in our future. if they move, Avery or another coach with experience would probably get an offer. I wonder if Clay contacted Larry Brown and asked him to wait on the Bobcats offer until Augusta?

Pick any team at random . . . hire the “best” coach in the league or the “worst” coach in the league. How much difference in the wins column do you predict. My guess . . . two games.

“I’d be happy with Johnson or D’Antoni taking over the Sonics. PJ just didn’t impress me at all, or perhaps better said, he lived up to my expectations. ”
I agree, however both those guys or any other serious candidate would be crazy to come anywhere near this organization right now.
“It is quite obvious that the league is easily on its way to a work stopage like the one the that happened in the NHL. One has to wonder if losing a year of playing will push the NBA closer to tier two status then MLB and the NFL. ”
IMO the NBA is already there and has been more or less since Jordan’s Wizards days. If they had a year long play stoppage (and I agree with Myk, it’s coming) they fall into total marginalization like the NHL, which for a pro sports league is one baby step above irrelevance. By marginalization I mean that the league retains its hardcore fandom but is unable to grow their core fanbase beyond what it is now. IRL/CART is another recent example. Stern can point to increased interest in NBA product in Europe and Asia, but those fans aren’t buying tickets or underwriting the business model that makes the league possible.
“Pick any team at random . . . hire the “best” coach in the league or the “worst” coach in the league. How much difference in the wins column do you predict. My guess . . . two games. ”
Probably no more than 5 or 6 at most either way.
hey, and how about the news that Larry Brown’s the new guy in Charlotte? How long y’all think that’ll last?
April 30th, 2008 at 12:28 pm
The problem is that Kevin Durant wants PJ out. How do you punish your potential superstar and risk having him leave after his first year in Oklahoma.
April 30th, 2008 at 12:29 pm
If this team does end up in OKC then I HOPE SO BADLY that the work stoppage happens in 2010/2011.
April 30th, 2008 at 12:31 pm
Also if they had a year long work stoppage I think it is very VERY likely half a dozen teams would fold, maybe more. When you have San Antonio, NOLA, Memphis, Milwaukee, Charlotte all having financial difficulty even playing complete seasons an entire year’s lost revenue would kill them.
The league in many ways has never completely recovered from the 98 lockout and how to market themselves in the post-Jordan era. I think another work stoppage would bury them for pretty much an entire generation of fans.
April 30th, 2008 at 12:43 pm
Sorry, but I would NOT want D’Antoni coaching the Sonics. His schemes don’t work in the NBA, especially in the playoffs. And the last time I checked, they don’t give trophies for winning 60 games.
When PJ leaves, I’d want Rick Carlisle, Dwane Casey, or Scott Brooks.
April 30th, 2008 at 12:44 pm
To Laporbo & T & anyone else who is wondering about hearing from Slade, Schultz, or the city of Seattle: These people are involved in active litigation. Having been thusly involved myself, I know that you never want to make public statements while litigation is ongoing. My attorney practically had to physically gag me when I wanted to hold a press conference while we were in litigation.
You should not expect to hear anything from them while the lawsuits are active. So you should get used to it. Just plan on attending SOS meetings for support and discussion. And talk to all your millionaire or otherwise wealthy friends, because we will be needing some money to fight this fight effectively. We need to make some presentations to some wealthy benefactors - maybe the local Billionaires’ Club, if there is one. I think we have more wealth here than OKC and some of them care about the Sonics’ fate.
April 30th, 2008 at 12:50 pm
ZenDoc, I’m also talking about more emails. They released all those other emails while in active litigation.
April 30th, 2008 at 12:50 pm
I forgot to say that certain people haven’t learned the lesson of not opening their big mouths while they are in litigation, people like Clay “Sock it to Me, Dave” Bennett and David “I am God, who the Hell are You?” Stern.
April 30th, 2008 at 1:04 pm

Is it just me, or does D’Antoni look like a hockey coach?

“…and David “I am God, who the Hell are You?” Stern. ”
LOL! nice one
April 30th, 2008 at 1:07 pm
Laporbo,
Ok - that’s a good point. I have no idea about the emails and I don’t know if any of us know if more are coming or not. They could also be saving some of those for trial and not be releasing them beforehand. It’s hard to say what their strategy is. Do we know for certain that there are more emails or are we just assuming that there are?
April 30th, 2008 at 1:23 pm
wait…. KD wants PJ out??? did i miss something?
April 30th, 2008 at 1:31 pm
SpeedCat,
I’m glad you like David Stern’s nickname. Should we see if we can make it his official nickname? Do you think that it would catch on in other NBA cities? That would be nice, but I think that most of them are still drinking his Kool-Aid.
On a somewhat more serious note, how many people do you have confirmed for Saturday’s SOS Meeting, and what is the capacity of the room? Are you taking any more suggestions for the agenda?
It will be so great to see K.D. get his ROY Award. Is he really coming to Seattle to receive the award? Doesn’t that mean that David Stern would have to come, too, or will he send an emissary? I can’t imagine that he would be willing to show his face in Seattle after he helped plan our demise, like the “Good Will Ambassador” that he is!
April 30th, 2008 at 1:33 pm
The city got thousands of emails for their case.
April 30th, 2008 at 1:36 pm
I heard that Durant also won the Defensive ROY award too. Where’s AK’s defensive rant? Its 1:36 pm.
April 30th, 2008 at 1:38 pm
nanea,
It’s not a secret that Durant and Green were unhappy with PJ, but you didn’t see a lot about it in press because Durant and Green kept it among the players and those in their “inner circles”. So while they’ve been unhappy with him, mocking him even, they have nonetheless handled it pretty well for being young bucks. I for one commend them for not talking to the press (ala Furious George) and making a stink about it publicly. They didn’t have any leverage to gain by talking to the news about it. I’m sure the people who need to know have the info on their dissatisfaction with PJ.
Big Chris
April 30th, 2008 at 1:42 pm
Maybe Sterno is arrogant enough to actually come here for the ROY presentation. If he does it would be preudent to bring bodyguards.
April 30th, 2008 at 1:45 pm
Beantown for coach. He has the balls to keep the young pups in line.
Here’s your lawsuit fix for today (via the TNT blog):
Seattle law firm Byrnes & Keller accepted a summons regarding former Sonics owner Howard Schultz’s lawsuit against the current ownership group on Tuesday, and will represent Sonics chairman Clay Bennett and the rest of the ownership group. Byrnes & Keller also is representing Bennett’s group in the lawsuit vs. the city of Seattle.
Bennett’s group has 20 days to respond to the complaint.
April 30th, 2008 at 1:47 pm
I think we have more wealth here than OKC
You think? King County ranks 10th in the country in number of millionaires.

Don’t send them to Montana!
April 30th, 2008 at 2:03 pm
How is George Karls job security? Probably no chance of getting him back due to his history/success with the team…..but I’d welcome the idea.
April 30th, 2008 at 2:12 pm
I think George Karl is a different coach than he was when he was with Seattle. I used to get ticked off that he never would never develop rookies.
April 30th, 2008 at 2:12 pm
What, don’t they have any good lahhyurz in OK City?
April 30th, 2008 at 2:12 pm
“Pick any team at random . . . hire the “best” coach in the league or the “worst” coach in the league. How much difference in the wins column do you predict. My guess . . . two games.
- Well depends…what if those coaches are named Adleman or McMillan?? J/K…much like baseball, I think a good coach can get you one or two more wins, while a horrible coach can cost your 5 or 6 wins.
Sorry, but I would NOT want D’Antoni coaching the Sonics. His schemes don’t work in the NBA, especially in the playoffs. And the last time I checked, they don’t give trophies for winning 60 games.

- So…D’Antoni’s schemes don’t work because they’ve won 60 games a year and made it a few playoff runs, but didn’t make the Finals? Yet, Dwayne Casey never made the playoffs, Scott Brooks has never coached and Rick Carlisle (who I do support is a good coach) has never accomplished as much as D’Antoni…
You might prefer a guy like Carlisle…but the argument you are using doesn’t make any sense. By your argument the only schemes that have worked in the last 25 years are Phil Jackson, Pat Riley, Rudy Tomjonvich, Larry Brown and Greg Poppovich, Chuck Daly…
Its great in this day and age in sports that coaches that win 50+ games year in and year out are considered failures. Sports is going to be an interesting landscape in twenty years.

How is George Karls job security? Probably no chance of getting him back due to his history/success with the team…..but I’d welcome the idea.
- They’d never hire George because we know for a fact that he’d be vocal about what was going on behind the scenes…his biggest problem is that he will say whatever he thinks even if it gets him in trouble.

I would think we have more billionaires in King County than all of OK.
Oh, and Bennetts a tool.
Just in case you didn’t know.

I know that this is all besides the point . . . and no longer relevant.
However, I though some of you might enjoy the comparison between King County and Oklahoma County (the home of Oklahoma City). All information is available from the U.S. census and is for the year 2006.
King County OK County
Median Household Income $80.8 K $39.0K
Per Capita Income $35.9K $23.8K
Population 1.8 million 0.7 million
Annual Personal Income $64.6 billion $16.6 billion

Dont forget the outlying regions of OKC that make up another larg portion of their states population, like Chickasha, Midwest City, Choctaw and El Reno. Combined, that adds another 50,000 potential Sonics fans, unlike our small towns outside King County like Tacoma or Everett!
April 30th, 2008 at 2:48 pm
So, yeah.
We all know that Seattle is far superior to OKC.
This is all about getting an arena.
Everthing else is just bullshit.
Except for the part about the team leaving in 2010 if we don’t have a new arena.
It is all about the arena.
SHOW me the ARENA!
worthless Olympia stooges.
So to be the Gov of WA. all you need is a pulse and motor skills?

Stan Kroenke already said he’ll be back next year.
That aside, Karl would be a horrible fit for this roster.

Thanks Big C for the KDvsPJ update… I had no idea… I knew some of the older players had fits with PJ, but I thought Green and KD were more inclined to stay out of it.
And i’m with Vinny…. WHERE’S THE ARENA (talk)?????????? Any movement there?
April 30th, 2008 at 3:10 pm

Congratulations on Kevin Durant being named ROY! You guys deserve something to cheer about.
As for D’Antoni, I’d hire him in a second. Avery Johnson’s available too.
April 30th, 2008 at 3:19 pm
Why is it that King County or the city of Seattle cant give the extra $75 million. This makes sense since thats where Key arena is and then we wouldnt even have to deal with the State legistlature. I dont get it can someone explain this please…
April 30th, 2008 at 3:37 pm
“Hey now…you are going to start getting called “elitist” by some people…only in America is being “elite” considered a bad thing.”
America must tired be all of the elite asshole business types, like Clay Bennett who’s trying to bilk his own state’s already poorly funded social services to subsidize an NBA team, and the executives of the US oil companies that are striving to run the middle class into the ground.
April 30th, 2008 at 3:48 pm
T, the county and city are afraid someone might get upset if they do something proactive, its just not how things are done around here. We have to wait for things to fall apart before we fix them. Take the Kingdome or the viaduct as examples.
Hey, maybe thats what we need to do, burn down the Key or flood it or something. Until its unuseable, nothing is going to be done about it. Anyone know people in Al Quida?
(Dear NBA and Homeland Security, the above passage was intended for humor purposes only, it is not intended to reflect the ideas or intentions of anyone using theis blog.)

His style is definitely different. He used to be all about defense. Obviously that isn’t a priority in Denver
However…….Alphonso Ford, Rich King, Dontonio Wingfield, Sherell Ford, and James Cotton didn’t get minutes for a reason.
If I remember correctly didn’t Eric Snow and Ervin Johnson get minutes as rookies?

Say we get 10 percent of those people, that’s what 5000?
5000 alcoholics = more beer sales=more revenue for everyone!!
See just more reason to stay!!
Now I don’t know but didn’t I read most Meth Addiction is coming out of Rural Areas particularly one’s with Oil Field’s? I know it’s an issue in Eastern Utah.

Despite Charles Barkley’s attempts to give ROY honors to Al Horford, Kevin Durant was the true deserving Rookie of the Year.
Durant was an easy choice for Rookie of the Year just like Brandon Roy was last year.
If you put Al Horford or Luis Scola in Durant’s position and made them the primary scorer and focus point of the offense. Where they would be double teamed and the have the best defensive player guarding them at all times their stats would definitely be much lower than what Durant produced.
I really wanna find out if they’re holding a press conference to give Durant his ROY award. I think it’d be great if the SOS group could attend that and support him and OUR team. We definitely need to look into that and find out if they truly are going to hold a press conference in Seattle.
I don’t see them firing PJ, and even though I don’t think he’s a very good coach. We have to realize that not even Phil Jackson was going to win more than 25 games with the team that Bennett and Presti put out on the floor.
I wouldn’t mind D’Antoni or Avery Johnson but I don’t think they’ll be firing PJ.
Well, hopefully we’ll have some more positive news coming out soon. And if I’m not out house hunting, I hope to see lots of you at the SOS meeting on Saturday.
April 30th, 2008 at 5:12 pm
Speedcat,
I couldn’t post in the thread on the message board, hopefully you see this here…
I frequent the fitness center at the JCC (great facility btw). I know that the building usually only opens at 2:00 PM on Saturdays. I assume you already talked to someone there about it, are they opening early especially for you guys?

I will definitely go buy one of those and check it out. I think that’s great. Very nice artwork as usual.
April 30th, 2008 at 5:43 pm
Jeff,
You better be coming to the SOS meeting on Saturday - it’s only 2 hours or so, so that gives you a lot of time to hunt for a house or apt, OK?
April 30th, 2008 at 6:47 pm
Hey all,
I have been lurking and reading for quite awhile. I remeber as a kid going to see games when Bill Russell was coach, I remeber when Slick Watts was doing his Harlem Globtrotters dribbling exhibition in the NBA. When the SEATTLE

His wife caught us and invited us in so I got meet Freddy, Jack, JJ and DJ. Don’t tell me that a franchise has no signifigance to a communtinty. I now live Eastern Washington. We rebelled against the Mariners Stadium, We had resentment for the Seahawks Stadium because of the Mariners Stadium but we are pissed off at the attempt to steal our team! If any of those Okies think they are tough country folk just sent them over the mountians and shut the passes! Thye should know what tumble weeds can hide.

its great the kd won rookie of the year..he had a good rookie season and the best is yet to come right here in SEATTLE!

Did anyone just listen to the KJR interview with Paula Duffey,an attorney who thinks the Schultz case doesnt have much of a chance? I hate hearing that it always brings me down and makes me sad. Then again she also said if the Citys case wins she thinks Clay Bennett will just sell the team back to Schultz which I doubt will happen. Anyway I just wish I didnt hear her speak so negatively about the Shultz case.
April 30th, 2008 at 9:15 pm
Congrats, KD!
————————————-
As far as the coaching deal goes, I personally think that assistant coaches are underrated in the NBA. Guys like Grgurich, Carlisle (when he was an assistant for the Blazers), and others really drive the success of a team.
But, I personally expect Presti to stick with his guns and keep PJ for at least 3 years. The expectations were low this year…no matter how you slice the pie. KD and Green are just passionate players who want to win. Even though the rotation was totally wacked this year, KD and Green did get some constant minutes together and showed improvement. A different coach who was more of a disciplinarian (like Silas…who I personally wanted as a coach) would probably have been criticized for making KD and Green earn their minutes…because the team would have lost regardless of whether those two got playing time in the NBA.
The NBA has no job security anymore. Any coach who has a system that can win in the regular season but does not result in rings gets screwed. The same thing happened to Karl in Seattle as might happen to Avery Johnson and D’Antoni. It’s just life in pro sports. Every quality pro sports head coaching job is like coaching college basketball at UCLA or football at Notre Dame. Deliver or you’re gone. It’s rare to find a GM like Presti who states that he wants to create a program or a winning system like they have in Utah. I’m okay with it unless the team doesn’t show any improvement…
April 30th, 2008 at 9:39 pm
Agreed, a very well deserved award.
Has any ROY winner ever had to go through as much off-court pressure as KD did this season?
April 30th, 2008 at 9:49 pm
PJ for 3 more years? The guy who refused to ever let Wally Z start, citing his lame “punch off the bench” excuse and when Wally did play, PJ made sure he was pulled before he got too much into a shooting rhythm or when we made a decent run with him in the game, whichever came first. I’m not a coach but I could go out there and do that and I’d have been a lot cheaper too.
When a team gets wins in spite of the coach rather than because of him it’s time to start making a short list. Dwayne Casey anyone?
April 30th, 2008 at 9:53 pm
T,
she’s been on before and really doesn’t sound like she knows the situation too well. I wouldn’t take what she says to mean much either way.
April 30th, 2008 at 9:55 pm
I think its sad Avery already got fired. They waited less than 24 hours. Hes accomplished a whole lot with that team but I think they are gonna start going down hill from here and I think its a blessing in disguise for Avery to get out of there. He wil for sure get hired somewhere else hopefully where hes more appreciated.

City Requests Trial Delay: http://seattlepi.nwsource.com/basketball/361333_arena01.html
April 30th, 2008 at 10:10 pm
Um am I reading this article (see above link) wrong or what? Because to me this does not seem like a good thing for our case. I am so not a lawyer though so can someone interpret it or give me there more educated opinion? Thanks!
April 30th, 2008 at 10:19 pm
I think it is a good thing. I dont think that it changes our case at all and the city lawyers by doing this pretty much guarenteed that the SOnics will be in Seattle next season if the judge agrees. I do not know if a jury is a good idea or not?
April 30th, 2008 at 10:20 pm
Anything which delays the June trial and forces the Sonics to play next season where they belong can only be viewed as a good thing.
April 30th, 2008 at 10:28 pm
1. “Did anyone just listen to the KJR interview with Paula Duffey,an attorney who thinks the Schultz case doesnt have much of a chance……. Anyway I just wish I didnt hear her speak so negatively about the Shultz case.”
Dude. Don’t stress. She’s a pundit. A radio pundit who likely washed out of corporate law. Not a litigatior. Not an expert. Minor league. Its like asking a family practitioner her opinion on a key brain surgery issue. Don’t stress.
Howard may not win the case. But, it gets to trial, no doubt. That’s 1 1/2 years away. A lot can happen, including good things in that case. She knows nothing about it.
2. “City Requests Trial Delay”
I love it. Another stumble by the Okies.
They ask to have a price set on the buy-out 1 week before the end of discovery, giving the City the PERFECT excuse to ask for a continuance in the case.
They will likely have to drop the issue or accept a delay. The issue is unlikely to go away, so a good chance of the case being delayed.
I really wonder if those OKies think any further ahead than a single step.
If we just had a capable group of legislators, this would have been done long ago. Where’s the ballot box???
April 30th, 2008 at 10:34 pm
Did anyone just listen to the KJR interview with Paula Duffey,an attorney who thinks the Schultz case doesnt have much of a chance?
I’ve heard Duffy on KJR, she is a loon and almost sounds like she us auditioning for a gig.
April 30th, 2008 at 10:35 pm
“Because to me this does not seem like a good thing for our case. ”
No big issue. The City should win before the judge ever gets to the issue of how much the buy-out would be.
The jury should be a very good thing, if it ever gets to that stage. How likely is it that a Seattle area jury will side with the OKies?
April 30th, 2008 at 10:36 pm
“Anything which delays the June trial and forces the Sonics to play next season where they belong can only be viewed as a good thing. ”
Yes I agree but to me it seems like IF the sonics are eventually awarded only monetary damages, then even if they are still here next year due to delay of trial, then that coukd mean they are only here next year rather then 2 more years. Am I way off?
April 30th, 2008 at 10:39 pm
That doesn’t mean that there will be monetary damages. The judge doesn’t have to order it. She can set it and not order it.
April 30th, 2008 at 10:46 pm
It looks to me like Bennett wants Judge Pechman to determine the amount of the lease buyout during the trial itself, if the team wins the case, to save Bennett the time and trouble of having to negotiate with the City - which thus far has shown no willingness to negotiate with Bennett.
A rather desperate, and disengenuous, move by Bennett’s legal team, and one which could very well backfire.
The judge could now grant the City’s request to delay the trial for 6 months, which would force Bennett and the team to stay here for at least 1 more season without even knowing the final outcome of the trial.
Or, the judge could determine the lease buyout should be far more than the $26.5 million Bennett already offered the City, which could force Bennett to back off and play out the 2 years.
Or, the judge could say she’s neither qualified nor prepared to set the buyout amount at this time, and thus agree with the City that separate negotiations would be required to set the buyout. Bennett would then be forced to either take his chances with the trial, or back off entirely.
Or, the judge could determine a *potential* lease buyout of an amount Bennett approves of, but then if Bennett loses the case and has to stay for 2 more years, it’s all irrelevant anyway.
The bottom line is, Bennett is stuck here for 2 more years. And this last-minute/last resort move by his legal team indicates he is desperate for a quick and easy exit strategy - which tells me he does not want to be here for one more minute longer than he absolutely has to be.
April 30th, 2008 at 10:53 pm
I heard that lady on KJR(for the 2nd time I think), and once again she sounded misinformed on some issues, and full of speculation. I don’t know why they even bother having misinformed people on there, waste of time, and airspace. Hopefully that’ll be her last time…
April 30th, 2008 at 10:57 pm
If anyone deserves blame in Dallas its Jason Kidd. Dallas made a bad move. It didn’t work and AJ got the scapegoat treatment.
April 30th, 2008 at 11:05 pm
The one good thing about KJR tonight was that Ian had laryngitis (sp?) and went home. No Ian ‘bail and run’ Furness!!
April 30th, 2008 at 11:09 pm
Not to add extra worries or anything, but there’s a slight chance the judge sets the buyout at, say $75m. What then? Do we agree and force Clay to pay the remaining ballance for rennovating the Key, but surrender the current team? If the judge sets the buyout high enough, might the city feel pressured to accept? I have no idea what casual and non-fans would demand from Mayor Nickels.
April 30th, 2008 at 11:12 pm
The Kidd trade sucked - at least for Dallas. New Jersey’s staff is probably laughing out loud right about now. They rid themselves of one of the 2 cancerous cells in their locker room, they got a young up-and-coming PG, some cap relief, and first-round picks from a team on the decline. Beautiful.
And thanks to the young talent, cap relief, and draft picks the Mav-nots gave up in that trade, Dallas won’t be in a position to substantially improve their team anytime soon.
Newsflash: Nowitzke is not a #1 Superstar, carry the team to a Championship kind of player. Never has been, never will be.
Howard is a nice #3 option when his eyes aren’t glazed over. Bass is a nice young cheap PF. What else do they have again? Terry, Stackhouse, Dampier, Kidd, Dirk - they’re all overpaid and they’re all overrated.
2 teams I would not want to work for right now: Mavs, Suns.
April 30th, 2008 at 11:31 pm
The City had to request a delay in the trial since the Okies are trying to change the rules of the game by asking the judge to assign monetary damages now IF they win the trial. Like the City of Seattle says it completely changes the nature of the trial and Seattle would need a lot more time to prepare testimony and get expert witnesses, etc.
Okies have requested an expedited trial - they want to get it over with as soon as possible so they can get the hell out of town IF they win. Now they’re trying to cram the monetary damages in there, too, which would have otherwise been handled after this trial. Seattle is saying NO WAY - you’re not playing fair, and if you want to do that then we need a six-month delay NOW, which definitely would guarantee us this year in Seattle at least. It’ll be interesting to see if the Judge grants either motion.

T, I’m wondering - & I’m not meaning to be sexist or anything, but - are you a chick? You sure seem to be up & down & get depressed real easy - very reactive to anything you read or hear.
You really have to take everything with a grain of salt and trust that we have very good attorneys. Then just get engaged in the activity to Save Our Sonics and do everything that you can to help out. That way you can make yourself feel better.

Yea, it’s pretty funny. You were sorta driving me crazy. I was getting these tremendous feelings welling up that I needed to slap you and tell you to stop being so hysterical! Call it sexist or call it sex differences. Our brains work differently. I promise that I won’t slap you. I feel better knowing that you’re female. I was about to tell you to stop being such a wuss.
John was apparently having some of the same feelings.

Does anyone know where the press conference is going to be Thursday for the ROY announcement? Is the PC being held in Seattle? If so, can we be there? Is K.D. in town?
May 1st, 2008 at 1:13 am
Ha … wow … I was reading this blog and I was like “Who’s this sexist guy? Oh wait it’s dad.” That’s never good….
I’m not sure if it was really a sexist comment but I’m sure it could have been worded better.
There’s a lot of people on here that seem to freak out with every bit of news. I think it’s the whole reason why Brian R. and others have referred to this as a Roller Coaster. There’s a lot of ups and downs with this scandal. And so it’s only natural for us to be really happy when we hear news in our favor and really upset when we hear things that support the team being stolen away from us.
As far as the trial being extended. Well you’d have to think that could only be a good thing. If it did get pushed back 6 months then we’re guaranteed the Sonics in Seattle for the 08 - 09 season. And if they win the trial, it’s through the 09 - 10 season as well.
I just want this thing to be resolved. And I’m not talking about settling and taking whatever we can get. I’m talking about the Seattle Super Sonics (with KD, Green and Co.) being the Seattle Super Sonics for good. This is so ridiculous that some rich MO FO can pay a whole bunch of money and take away something that has been apart of the city for 40+ years. And the fact that this seems to be OK with several people. David Stern is HAPPY this is happening and is doing everything he can to support it. The other NBA others have voted to approve this as well. These people are HORRIBLE human beings.
Why don’t we have Steve Ballmer and Bill Gates just buy all the land of OKC and demolish the entire city. And build an entire cities worth of Microsoft buildings there… Leaving thousands of Okies without homes.
Is that nice? Is that fair? Hell no it’s not! But neither is stealing an NBA team away from a city that’s supported it for over 4 decades. Apparently, you don’t have to have morals if you’re filthy rich.
This whole thing disgusts me! I hope for the life of me that we win this battle and that Bennett and Stern fail in their evil attempts to steal our franchise.
Go get your own team and leave us the F* alone.

ESPN now reporting that Al Horford rang Durant before the Hawks-Celts game tonight to congratulate him on winning the ROY, but didn’t make a public statement so as not to spoil the official announcement on Thursday. So it’s about 99.999999% confirmed that KD is ROY. Classy work from Horford too, I have to say.

(Just got home from the bar, so the thoughts are flowin’. Please, therefore, excuse the lack of coherence.)
That really resonates truly with me, for all pro sports, and most owners/teams. Which makes me think of Bill Cowher. How long did he coach the Steelers before they took home the Lombardi Trophy? Like 10? That seems like a long time, but how long have we (Seattle) been without a major sports championship of any kind?
The last MAJOR championship (IMO, and with apologies to the Storm who won it all and kick butt in general) was the Huskies Football team in ‘91-’92. That’s over 16 years ago. That’s not (arguably
) even a professional team!
So which is better:
1) a coach that is ~.500 over his career, but gets a championship? (Lenny Wilkens)
or
2) a guy who goes .650+, competes in the playoffs every year, but never takes the title? (Rick Adelman)
and
3) if that .650 guy was given another few years(even when fans are calling for his head), would he win a title anyway? (Larry Brown)
Being a sonic fan, I prefer Lenny. And I think George Karl can of win a title.

as i counted down the seconds to the ‘79 championship, i realized that it was the happiest moment of my entire life. mind you, i was in 11th grade, and going to school in WASHINGTON D.C., where i spent the latter part of my childhood, in exile from the great nw. . .
even as years passed, that championship hasn’t dulled in my mind. every year, when the nba finals are over, i scan down the all-time list, see “seattle supersonics,” and smile.
a championship is the most precious prize of all. so my vote goes to lenny, not a second thought.

Avery is a survivor. As an undrafted Sonics rookie out of Southern U, he started a career where he bounced around the league for years, never giving up, always catching on somewhere. Anyone who was cut on Christmas eve, as he was by Denver, would have every right to be depressed but he just dusted himself off and kept on trucking. I’m surprised Cuban made him the scapegoat. Anyway, I have no doubt that there will be a bidding war for his services between several teams and he’ll come out on top once again. Class personified.

Many people were close to jumping off the cliff after the BoG relocation vote, and I assume most of them were men. Women are not the only ones that ride the roller coaster.

Okay,
I know you all need info from sources other than here. But if I can recomend that you just stay away from KJR in the evening. Furniss is a joke. He was on air and a PD down here in SLC at both the station I worked for and then the competition. He thrives on controversy and using that controversy to drive ratings. He’s a very poor man’s Locke.
If you want rid of him don’t listen. The only way a station PD/GM will drop him is if his ratings are for crap or people refuse to advertise in his time slot. If you must listen just don’t stress it whe he says what he says or has an “expert” on.
Realize his MO is to evoke a response that’s all. I can guarantee you that if everyone were saying leave he’ld be saying stay and have “experts” on to prove his case. DON’T TAKE THE BAIT!
May 1st, 2008 at 7:37 am
The city believes the financial question involves far more than just the basic rent owed under the lease.
“The City would be entitled to the full scope of the consequential damages of PBC’s breach. Establishing the amount of these damages would require evidence on issues including the broad economic impact of the Sonics on the City of Seattle. Such a measure may include taxes on both the direct and indirect economic activity related to the Sonics games, including employment taxes, parking revenues and entertainment and related spending before and after games,” the city said.”
As I alluded to before, this judge will make a decison as to what the lease is worth. I suspect the lame duck status of the team will discount the value of all the ancillary revenue the City has listed above.
So, instead of fighting battles with tax payer money that they will eventually lose, they should have invested tax payer money in an all purpose areana solution that would have kept the team and added more revenue to the City’s coffers

As I alluded to before, this judge will make a decison as to what the lease is worth. I suspect the lame duck status of the team will discount the value of all the ancillary revenue the City has listed above.
I think you are wrong, as usual. The Judge will not have to make a decision on the “value” because the Judge isn’t going to allow the Sonics to buyout the lease. The Sonics have to first prove economic hardship in order to justify getting out of the lease and they won’t be able to do that.
The Sonics are stuck in Seattle for at least two more seasons.

“because the Judge isn’t going to allow the Sonics to buyout the lease. The Sonics have to first prove economic hardship in order to justify getting out of the lease and they won’t be able to do that. ”
It’s not a foregone conclusion that the Judge will not mediate this disagreement. If so, why is the City even woried about gaining more time to come up with these economic figures?
May 1st, 2008 at 7:57 am
Here is the full article on the Cities request for a delay in the trial.
http://seattlepi.nwsource.com/basketball/361333_arena01.html
May 1st, 2008 at 7:59 am
According to the city’s motion, PBC attorney Brad Keller made a strong case during the pretrial scheduling conference on Jan. 29 that only limited discovery was needed because of the narrow scope of the trial.
Priceless. The Okie’s attorney made a good case for a quick trial, when just deciding on the “Performance clause” in the lease, now that they’d asked for the “monetary damanges” to be included they are screwing up and giving the City the opening to push the trial date back into the start of next season.
They are tripping over their own d*cks in their rush to steal the Sonics from Seattle.
May 1st, 2008 at 8:04 am

It is a foregone conclusion, but you just keep you Okie hopes up and your head firmly planted in the ground. The dumb Okie’s opened up the door for the City to delay the trial due to their request to include more a complicated ruling (monetary damages) outside of just the simple “performance clause”. That gives the City what they want, to keep the team in Seattle longer by allowing them to delay the trial date.
Deciding economic damages is never a simple case. Lots of discovery, witness calling, economic analysis………..Okies falling on their faces again.

Actually Dude, it’s a great case of misdirection. They caught the City flat-footed. They could care less about a delay of 6 months when thay can get out of the lease before 2 years.
May 1st, 2008 at 8:42 am
Producer, once again you are hopelessly wrong. Their goal was to have a very quick trial, win the case and move to Oklahoma for the 2008-09 season. This action basically assures that that won’t happen.

Great.
This was designed to get the trial out of the headlines during the Finals. Mission accomplished!
Okies set bait and the City jumped all over it.
Mistake by the City IMO.
May 1st, 2008 at 9:08 am
Bennett is screwed at this point. His lawyer is boxed in. Even if Bennett wins on the specific performance issue there will be a second trial to set the amount of the buyout. Either way he will not be clear of his Seattle liability until after the 2008/2009 season starts. What if the second trial sets a buyout at $500M. He would have to stay in Seattle two more years, anyway. He cannot leave until he knows the amount or the city gets a blank check.
The judge will likely reject the petition to include the amount of the buyout in the first case. It is too late. If the city wins the discovery and second case is unnecessary. It is best to proceed with the single issue trial in June and if necessary come back for a settlement amount.

May 1st, 2008 at 9:09 am
I don’t think headlines during the NBA finals are that big of a deal, especially if it promises one more year. A lot can happen in a year…
May 1st, 2008 at 9:12 am
Producer, I don’t think they caught the city flat-footed at all. They would be completely changing the trial if the judge grants their motion, so, of course the city is going to need a lot more time to prepare for that. In that sense, I suppose you could say they caught the city “flat-footed” because the city thought the Okies were pushing for a quick trial and quick decision and they know and the judge knows that that can’t be done if they also want monetary damages set instead of just a ruling on a simple performance clause. The judge pretty much has to rule in favor of both motions or she has to deny both motions. If she allowed one and not the other, then something is wrong with that picture.
May 1st, 2008 at 9:13 am
Vinny - I would be curious what your reasoning is behind that. The owners (I refuse to call them the Sonics in this case) filed a motion last week. The City HAD to respond - they couldn’t just ignore it. The response was dismiss the motion or if you feel like ruling on it postpone the case so a different strategy can be prepared. Seems reasonable to me.
The Okies don’t want to be in Seattle another year. I find it hard to believe this strategy was employed simply to get the case delayed so it wouldn’t coincide with the finals. To me this seems like they are grasping at straws and can’t decide on a strategy.
May 1st, 2008 at 9:18 am
Exactly, brett. The Okies wouldn’t sacrifice another year in Seattle just so they can avoid having the trial occur during the Finals. Their goal is to be in OKC RIGHT NOW. They were outmaneuvered by the city on this one.
May 1st, 2008 at 9:19 am
Is anyone planning on being at the T-Mobile office in Factoria at 11:30 AM today for the presentation to K.D. for ROY? Can anyone go to the presentation? If so, can someone who is close take some S.O.S. signs and try to talk to Kevin if possible?
May 1st, 2008 at 9:22 am
“To me this seems like they are grasping at straws and can’t decide on a strategy. ”
The light just went on with Mr. Bennett that even if he wins the trial does not determine the amount of the buyout. He still doesn’t have what he needs to make a decision to leave or stay the remaining two years.
May 1st, 2008 at 9:24 am
Whats up T. Everything makes sense now. Man, you were starting to depress me with how low you would get on any news. I feel better now knowing you are a chick. Nothing wrong with your feelings. You seem very passionate about the Supes and so am I.
There should be some kind of fan support for Durant if possible. Show him how much the Supes are loved around here. I cant go, I live 2 hours away with no traffic. Probably 3 hours today. I hope to see something on the news.

Producer, whether the trial is delayed or not delayed, the only way this can be seen as good for the PBC is if they win their case against the City, which looks, at this point, to be in the City’s favor. Nor did they catch the City flat-footed…do you not think that the City had considered this would happen? Certainly they had, and were ready for it with this motion to delay. If Judge Pechman grants the PBC’s motion, and the City doesn’t get a delay, the City could still win in court, and make all of the PBC’s maneuvering worthless.
Waiting until the last minute may work on EBay, but it’s generally frowned upon in federal court.
May 1st, 2008 at 9:27 am
I see only good in delaying the trial by 6 months and keeping the team here for another season.
the national media during the finals will likely be biased against us anyways, and i’m sure stern will make statements during the finals downplaying the chances of the team staying in Seattle.
so i would take one more season, and move forward with the schultz case and convincing gregoire she won’t get re-elected if an arena proposal doesn’t happen.
May 1st, 2008 at 9:29 am
Newsflash: Nowitzke is not a #1 Superstar, carry the team to a Championship kind of player. Never has been, never will be.
- Care to give a list of players who do qualify for this list?? Not sure I can think of a player who has carried his team to a championship since Jordan…even he had Pippen.
Does Kobe qualify?? I mean he was carrying his team to championship games left and right before Gasol came around.
May 1st, 2008 at 9:34 am
Ok. So my other thought is that since the City was denied financial info in the NY court then the Okies thought:
“well lets bring up the financial aspect again since them Seattle fellers ran into a dead end in NY.”
Does this open the door for more financial records from the league?
May 1st, 2008 at 9:38 am
so the t-mobile in factoria, is that the office (not store) I am assuming. Is there any other info?? where at t-mobile. I might be able to go during lunch.
May 1st, 2008 at 9:42 am
The City had to request a delay in the trial since the Okies are trying to change the rules of the game by asking the judge to assign monetary damages now IF they win the trial. Like the City of Seattle says it completely changes the nature of the trial and Seattle would need a lot more time to prepare testimony and get expert witnesses, etc.
- Im confused…if the judge comes up with a number then what is the point of having a trial?
May 1st, 2008 at 9:44 am
As I alluded to before, this judge will make a decison as to what the lease is worth. I suspect the lame duck status of the team will discount the value of all the ancillary revenue the City has listed above.
- If this was true (which just doesn’t follow the whole idea of logic)…shouldn’t Bennett just cut all his players and say his team isn’t going to play any games in the Key Arena next year?
I mean if you are trying to say that somehow the buyout number gets to be reduced because he sabatoged the team and therefore won’t be worth as much…you are crazy.
May 1st, 2008 at 9:46 am
Producer…you do realize this sets things back to what….November? Flat footed? If by flat footed you mean the SuperSonics will be playing in Seattle for another season than YES….that would would be flat-flooted.
Plus, what makes you think that their(the City) discovery will go any different than it has in the last little bit? Enough said, bro. Wow, are you like a hired yokel or what?
May 1st, 2008 at 9:47 am
Myk, the Okies want the number set first before it’s decided whether or not the judge will actually rule in their favor - just in case she does rule in their favor - then they can finish packing, pay the bill, and get out of town. But it doesn’t make a lot of sense. I think she’s likely to deny both motions, then deal with monetary damages, IF the Okies win, which isn’t that likely.
May 1st, 2008 at 9:47 am
Now they get to deal with what a ROY will do to your team value
May 1st, 2008 at 9:48 am
“I suppose you could say they caught the city “flat-footed” because the city thought the Okies were pushing for a quick trial and quick decision and they know and the judge knows that that can’t be done if they also want monetary damages set instead of just a ruling on a simple performance clause.”
Which PBC would have lost (simple performance clause). I do think this has been all about economics from day one. PBC said so. I don’t think it will delay the trial longer than 3 months - IMHO. I do think the City was surprised and now they have to scramble to document that the loss of the team wil exceed the amount of the lease. They will come up with a number and the PBC will have their own and the judge will likely settle it for them. Contray to popular opinion on this board, judges are arbiters who judge by case law. In this case, she has wide scope to craft a solution.
May 1st, 2008 at 9:51 am
“I think she’s likely to deny both motions, then deal with monetary damages, IF the Okies win, which isn’t that likely. ”
PBC does not have to win the specific performance clause aspect for the judge to approve buy-out. I think effectively, PBC is acknowledging defeat on that one.
May 1st, 2008 at 9:55 am
I welcome comments from our guests from Oklahoma and deplore any rudness expressed towards them. However, anyone posting who stands to benefit financially or who has ties to the team or its promoters, whether formally or informally, should identify themselves as such.
My opinion is that the judge will avoid a long trial on financial matters by determining that the PBC must abide by the lease. Unless the City of Seattle voluntarily settles, the judge will rule that the contract will not be unilaterally voided or rewritten, and that the contract’s terms may be specifically enforced. In accordance with long-standing precedents, injunctive relief will be granted to the City of Seattle.
May 1st, 2008 at 9:56 am
Producer, please explain how the PBC can win without winning the specific performance clause issue?
May 1st, 2008 at 9:57 am

- It just seems by coming up with a number you are agreeing that a number is possible…and the City’s case is that there is no number that can be assigned to Specific Performance. Therefore, by coming up with the number you are saying the City’s case does not have merit.
May 1st, 2008 at 9:59 am

You really don’t get it. A judge CANNOT approve a buy-out if the specific performance clause is upheld. It would go against the very nature and definition of specific performance. Whatever your misguided notions are about this entire legal process, let me be clear. If the specific performance clause is upheld, the team will be forced to stay for the duration of the lease. No ifs, ands, or buts.
May 1st, 2008 at 10:06 am
Bennett: “Well since I can’t buy out the lease, how much to buy out specific performance? And if that don’t work, how much to buy the judge? Judges can’t be much more expensive in WA than they are in OK, can they? Hell, I’m rich enough to do whatever I want, whenever I want.”

Money damages can substitute for specific performance
- Again…isn’t this the whole point of the case? Wouldn’t this be like if in a class action lawsuit the judge told the two parties that when they won the award would XXX million dollars?
How can you decide the award of the trial before the trial has been completed?
May 1st, 2008 at 10:14 am
Money damages can substitute for specific performance.
No, they cannot. The only way a buy-out would be possible is if the city agreed to it. That is not going to happen if the specific performance clause is upheld.
May 1st, 2008 at 10:18 am
“No, they cannot. The only way a buy-out would be possible is if the city agreed to it. That is not going to happen if the specific performance clause is upheld”
Yoon, you have never been in court have you? When you sue and go to trial anything can happen. It is a roll of the dice. The judge can force a ruling whether the City likes it or not or whether the PBC likes it or not. The judge can rule that the SPC is valid but economic hardship allows for a buy-out at a certain number. That would satisfy the SPC.
I know how this works.
May 1st, 2008 at 10:18 am
Producer, money damages do substitute for specific performance when performance is impossible or there is other cause to excuse specific performance (such as a breach by a party). An example is a contract to remodel an apartment building that burns down, so there is nothing left to remodel. Contracts must be performed even when to do so would result in economic losses to a party. There is no reason why the Sonics could not play at Key Arena until 2010. Any losses to PBC would be a self-imposed hardship. Therefore, this particularly contract will be enforced according to its terms.
May 1st, 2008 at 10:19 am
“Money damages can substitute for specific performance.”
Uh… I don’t think that provision is included anywhere in the Sonics’ legally binding lease agreement with the City of Seattle. You know, the one Clay Bennett assumed when he bought the team?
Again: HAHAHAHAHAHAHAHAHAHAHAHA at Clay Bennett and his OKC flunkies.
May 1st, 2008 at 10:21 am
no, either there is article II performance, play every regular season game is required or it isn’t and they can pay out the lease
one, or the other, not both
The city countered by saying the Specific Performance was the only thing PBC is wanting judgement on, that is all the city is prepared for in the upcoming June trial. If PBC wants to widen the scope to financial arguments the the city has retained the right to a trial by jury, and it insists on six months to prepare for that added statement of work, discovery, experts, etc
May 1st, 2008 at 10:24 am

- Yes….the basic premise of your argument is that “anything could happen in court”…by your same theory then its just as likley that the Judge decides the team is worth $500 million dollars and force Bennett to pay because he asked to pay it.
Does that seem logical to you?
May 1st, 2008 at 10:25 am
“that provision is”
Does not have to be a provision in the contract.
May 1st, 2008 at 10:27 am
Economic hardship.
- Again…why would the judge reward the business for failing?? Surely you are smarter then this…
May 1st, 2008 at 10:27 am
Producer is right. It is a craproll in court. There are lots of bad judges, and good judges who make bad decisions.
The case law is very much against the PBC. The judge will possibly have a bias towards the local region of the venue - Seattle. The public eye will be watching. I would not hold my breath waiting for a bad decision in this particular case.
May 1st, 2008 at 10:29 am

Producer - I’m an attorney. In this case, if a judge upholds the specific performance clause, there is no reason a judge would substitute specific performance with monetary damages. Unless performance would be impossible, specific performance would require the team to play its games in Key Arena for the remainder of the lease. I’m sorry, but you are simply wrong on this issue.
May 1st, 2008 at 10:30 am
One thing this also does…it gives Schultz’s case the spotlight. IF anything, this request of PBC’s shows how far behind the city they really are. They are trying to play catch up by making shortcuts, but the City is just going to keep heading them off regardless the direction they try to take it.
So, the only thing that we know for sure…is that discovery will delay this thing into the beginning of next season. Which means the court case will not actually begin until that point, nor will it end until at least months later. So, the SuperSonics will be in SEATTLE…for at least one more year.
May 1st, 2008 at 10:33 am
Producer is right. It is a craproll in court. There are lots of bad judges, and good judges who make bad decisions.
- It just amuses me that his argument is basically that it could happen because in life anything could happen. If that is the case what is the point of predicting anything? If you are not going to make predictions based on past precedent then you might as well say anything…
Maybe the judge will actually tell them the that the dollar payout is $0 and that the City actually owes the Sonics money for holding them in town…
Maybe she says that the Sonics only needs to play 27 games in Seattle to satisfy their specific performance. However, those 27 games must be played against teams who’s name do not end with S and are based in cities with an average annual rainfall greater then 32 inches…
Basically…stop wasting time trying to argue something based on a fantasy world or based on the judge essentially going out of their way to create new prcedent. It is a waste of time.
May 1st, 2008 at 10:38 am
The case law is against economic hardship as a cause to void or rewrite a contract that has a strong specific performance clause such as the one contained in the Key Arena lease. There is no reason why PBC cannot perform. Suffering a loss is not sufficient grounds for relief. For this reason, the judge will issue an injunction through 2010.
May 1st, 2008 at 10:44 am
Yoon Says:
The only way a buy-out would be possible is if the city agreed to it. That is not going to happen if the specific performance clause is upheld.
Maybe, maybe not. Tom Carr was on KJR this week and he said if a buyout offer reached a certain level, the City would consider it.

AHAHAHAHAHAHAHA!

So anyway… how about the SEATTLE SuperSonics’ Kevin Durant!?
Way to represent the Pacific Northwest, KD!
May 1st, 2008 at 10:54 am
Bennett’s lawyer’s are trying to squeeze the judge. It might be a fairly logical 2 step given the actual strength of their cards. But to win they have to win on relief from specific performance and quick determination of monetary compensation. They are unlikely to win on the first and the second becomes moot but to win, really win- move this summer- they have to win on both so they are going for it. They probably couldn’t get short trial if they’d gone from both objectives from start so they got short trial schedule and now are trying to squeeze the judge to add the second objective and keep a shortly short schedule. I don’t think they have much chance of success but they have made it a bet on a procedural call in the process of the trial rather than a call beforehand. I can understand that bet but it shouldn’t work, probably won’t.
May 1st, 2008 at 10:59 am
AHAHAHAHAHA!
May 1st, 2008 at 10:59 am
should be in abovve … “fairly” short schedule.
Bennett starts out stuck here, a loser on specific performance. All that can happen is that he wins.
A judge setting the number would be a win.
Enticing the city to a number is either going to be impossible (without Stern kicking in a team) or more expensive by negotiation than judicial determination.
May 1st, 2008 at 11:01 am
Well, yes, if the buyout was high enough, the city should agree to take his money, why not, since Schultz will just file an injunction to keep the team from leaving, and for the last time. . .
It may not be Bennett’s team.
That will be in question, can Bennett agree to a buyout of a team he may not have the right to own?
Until that case is settled he is stuck.
May 1st, 2008 at 11:03 am
Maybe, maybe not. Tom Carr was on KJR this week and he said if a buyout offer reached a certain level, the City would consider it.
Certainly that is true. However, I believe it would have to be an amount of such significance that it wouldn’t be practical for Bennett to pay it. It would have to be more than simply paying off the remainder of the lease and some additional damages. If the city is already arguing that there is an intangible benefit to the city (and its constituents) by having an NBA team here, it would have to exceed the amount of compensatory damages.
May 1st, 2008 at 11:11 am
It’s amusing to see Producer display such conviction that he is right, when he is obviously way off base. You can only laugh at him.
May 1st, 2008 at 11:15 am
Maybe, maybe not. Tom Carr was on KJR this week and he said if a buyout offer reached a certain level, the City would consider it.
He also said a few weeks ago that there is no number that they would consider. So he is changing his tune. Can the city be trusted?
May 1st, 2008 at 11:18 am
I don’t remember Carr or Nickels ever stating that there is no number that they would consider. That would be a ridiculous statement. Theoretically, Bennett could offer a billion dollars and it would be a breach of the Mayor’s fiduciary duty to reject such an offer.

You haven’t been in this city long have you? Of course the city cannot be trusted. Just look at the Viaduct, Monorail, and lets not forget “special endowments” given to campaign contributors by the city officials over the years.
May 1st, 2008 at 11:21 am
That being said, I agree with Yoon - it is highly unlikely that Carr/Nickels and Bennett will reach a mutually agreeable buyout figure before the trial starts.

I believe I heard it on a KJR interview. It might have been Ceis but I do remember it being said. There would have to be a another team in the deal not just money.
Can the city be trusted?
You haven’t been in this city long have you?
I have lived here for 51 years. I know the city can’t be trusted. I was trying to be funny.

I’m pretty dissappointed in the lack of info on the Kevin Durant’s acceptance of the Rookie of the Year honors. Besides the one or two posts on here (if you read all 175+ posts) that mention he will be appearing at the T-Mobile building / HQ for his ROY honors. There has pretty much been no news on it.
Checking some of the local papers didn’t reveal much at all about the actual press conference. Just saying he’d be in Seattle to accept the award.
And I know it was fairly last minute, but it would have been nice to get a group of SOS members and go and support him.
I just feel like the NBA and Bennett tried to hide this information and not post about it so that nobody in Seattle would really hear about it until after the press conference was over.
I think that’s a real shame because I would have loved to have gone and supported him with you guys.
It’s frustrating for me, being available but not being able to drive yet due to ankle surgery on my right foot.
I really hope that at least some fans, like maybe Big Lo, were able to go over there and support him!
May 1st, 2008 at 11:37 am
“Durant is the bright spot on a dismal basketball scene in Seattle. The Sonics won only 20 games and the owner is moving the team to Oklahoma City.”
Just noticed this piece of crap part of the AP release on KD winning the ROY award…
May 1st, 2008 at 11:40 am
So, who will be the NBA flunky that comes out here to present KD with his award? KD needs to make a statement by staying in town and having the NBA come to him. I saw him at the Wizard’s home game last week. Is he back in town working out? Do we know that he will be presented it here? Stern must be sweating through his “Children’s Husky Size” suit about how to handle presenting this without litigation coming up in the conversations.
May 1st, 2008 at 11:45 am

Softy is trying to KD on the radio and he is getting nothing from the Sonics!!!!! Suppression of the media by STERN!?!?!?!?! Why can’t they give us any enjoyment? Any information? Any access to OUR ROOKIE of the year? OUR ROOKIE OF THE YEAR!!!!!!!!!
May 1st, 2008 at 11:57 am
To Dork, Stern wouldn’t DARE show his face in Seattle. He knows how we feel about him and his B.S. He couldn’t pay enough bodyguards to protect him. He had to send a flunky. I don’t know who’s decision it was to hold the ceremony here - if it was T-Mobile’s or Kevin’s or the Sonics or the NBA. It would be interesting to know. But think of what a slap in the face it would have been if they had decided to hold the ceremony in OKC. Talk about inciting to riot! I’m sure that not even Clay would have wanted that. Sam Presti said P.J. is definitely coming back next season.

The Sonics have stonewalled KJR all year long and have not allowed any interviews on KJR with their players, their coaches, their staff, etc. Just more “bad faith” from Clay. It’s real disgusting, but Clay doesn’t want the citizenry of Seattle to get excited about the Sonics or conspire together to keep them here. He doesn’t even want to throw us a bone. There’s no Good Will on his part.

Not true, I barely listen to the radio and I heard interviews with both Sam Presti and Chris Wilcox. In the Wilcox interview he openly criticized the direction of the team.
May 1st, 2008 at 12:18 pm
I think it was Gas (maybe Groz) that said that he had been denied access to all Sonics players and coaches all year long and this was the first year since he had been in Seattle that he had never had a Sonic on the show and he couldn’t even believe it. Whichever one it was, I’m pretty sure that the other one who was on at the time (Groz with Gas) agreed that he had not been able to interview anyone either. So, whose shows were Wilcox and Presti interviewed on, and I wonder why if they were stonewalling other DJ’s?
May 1st, 2008 at 12:21 pm
Not true, I barely listen to the radio and I heard interviews with both Sam Presti and Chris Wilcox. In the Wilcox interview he openly criticized the direction of the team.
I honestly think those are the only two interviews they have had this year, including one with Jeff Green. Three interviews for an entire year?! Ridiculous. They might have had one or two more, but the point is still valid…this team is deliberately attempting to quell fan support of this team. Even after acrimonious split between KJR and the Sonics, they would still have player interviews almost weekly.
May 1st, 2008 at 12:22 pm
When was the interview with Wilcox? If it was early in the season, maybe his interview was the reason that the team decided not to allow access to players anymore. Maybe they didn’t want any more criticism of the way they were doing things …
May 1st, 2008 at 12:24 pm
No, it was about two months ago.

It was Gas.
May 1st, 2008 at 12:40 pm
It’s nice to know that there were 3 interviews with Sonics or Coaches/GM all year long. Does anyone know of any others? Do you have any idea of how many times that KJR DJ’s requested interviews with Sonics players or coaches? I wonder if they allowed a certain DJ to do a couple interviews - someone who they didn’t think was as threatening maybe? What was KJR’s official excuse for not allowing so many interviews all throughout the year? I don’t know the answers.
May 1st, 2008 at 12:44 pm
If Gas had an interview, then it must have been Groz who said that it was the only year since he’s been in Seattle that he never had a Sonic player or coach on his show, and it certainly was not his choice as he had tried several times to set up interviews.
May 1st, 2008 at 1:14 pm

No, it was Gas and I’m talking about the Chris Wilcox interview. I remember that it was Gas because A) he’s got the most annoying and childish voice and B) He kept thanking Chris for standing up for Seattle fans when in fact, he was only standing up for the players and just wanted to know if they’re moving or not.
